How Long Will They Stay in Jail Without Bail?

One of the first questions every family asks is: “How long will they be in there?”

The honest answer is: it depends. But the most important factor in shortening that time is  how quickly bail is posted.

Phase 1: Booking (Cannot Be Skipped)

After an arrest, every person must go through the booking process before bail can be posted. This typically takes 2 to 8 hours depending on facility workload.

Booking includes:

  • Recording personal information and charges
  • Fingerprinting and photographing
  • Medical screening
  • Property collection and storage
  • Assignment to a housing unit if bail is not yet posted

You cannot speed up booking — but you can use this time to call a bail bondsman and have everything ready the moment bail becomes available.

Phase 2: Bail Assignment

Bail Schedule (Faster)

Most common offenses have a preset bail amount on a bail schedule maintained by the county. For these cases, bail can be posted almost immediately after booking.

Judge at Arraignment (Slower)

For more serious charges, bail may be set by a judge at arraignment. Arraignment usually happens within 48 to 72 hours of arrest. This means your loved one could stay in custody for up to 3 days before bail is even set.

Phase 3: Release Processing After Bail Is Posted

  • San Diego Central Jail:  Approximately 4–8 hours after bail is posted
  • Las Colinas Detention Facility:  Approximately 4–8 hours
  • George Bailey Detention Facility:  Approximately 4–8 hours

  • Note: Times vary based on facility workload, shift changes, and staffing
